## Should I Contact the Listing Agent Directly? What Buyers Need to Know
In today’s digital real estate market, buyers have access to an incredible amount
of information. Online listings offer high-resolution photos, 3D virtual tours,
and detailed property histories at the click of a button. Because of this accessibility,
many buyers ask themselves: _Do I even need a buyer’s agent, or should I contact
the listing agent directly?_
It is a valid question. In fact, before I became a licensed agent, I did the exact
same thing when purchasing my first two homes. I thought skipping the middleman
would save time and money. However, I learned the hard way that navigating a real
estate transaction without dedicated representation rarely works out in the buyer’s
favor.
### The Myth of Saving Money by Going Straight to the Listing Agent
Many buyers assume that if they don’t use an agent, the seller’s agent will simply
cut their commission in half and pass those savings on to the buyer. In reality,
this is rarely how it works.
Following the historic **NAR settlement**, buyer agent commissions are no longer
automatically coupled with listing commissions in the MLS. However, sellers still
frequently offer these funds as a buyer concession to attract competitive offers.
If you choose to contact the listing agent directly to write your offer, that agent
will often keep the entire commission for facilitating both sides of the transaction.
You pay the same total price for the home, but you lose out on independent advocacy.
### Understanding Dual Agency: Who Does the Listing Agent Represent?
When you ask a listing agent to write an offer for you, they enter a legal arrangement
known as **dual agency**. In this scenario, the agent represents both the buyer
and the seller simultaneously.
While dual agents are legally required to act as neutral facilitators, true neutrality
is incredibly difficult to maintain in practice. Consider these critical limitations: * **Fiduciary Duty:** The listing agent signed a binding contract with the seller first. Their primary obligation is to secure the highest price and best terms for that seller. * **No Negotiation:** A dual agent cannot negotiate on your behalf. They cannot advise you to offer less money, nor can they aggressively fight for you during repairs. * **Limited Protection:** Without your own agent, no one is actively looking for hidden red flags in property disclosures or structuring contract contingencies strictly to protect your deposit.
Ultimately, using the listing agent means you receive limited, administrative help
while missing out on full-service advocacy.
### Protect Your Interests on Your Next Purchase
Buying a home is one of the most significant financial milestones of your life.
While it might seem efficient to contact the listing agent directly, doing so often
leaves you unprotected and without saving you a dime.
You deserve an experienced professional in your corner who is legally and ethically
bound to your best interests. If you are preparing to buy or sell a home and want
